Childhome has no control over content or polices of third-party websites, and are under no circumstances liable for content, accuracy, or reliability of any web sites hyper linked to this website.

We hope you enjoy using the Site. Because of the unique and exciting nature of the Internet and our desire to provide you with a great experience, we need to point out to you some legal rules of the road (hereinafter referred to as (“Terms and Conditions”) as they apply to your visit here and use of the Site. 1.          Agreement with Our Terms and Conditions

By using this Site, you agree to accept these terms and conditions, so please be sure to read them carefully. If you do not agree with them, please do not use the Site. We reserve the right, at our discretion, to change, modify, add or remove portions of these terms and conditions at any time. For this reason we encourage you to review this page periodically for changes.

All billing and registration information provided must be truthful and accurate. Providing any untruthful or inaccurate information may constitute a breach of these Terms and Conditions. By confirming your purchase at the end of the checkout process, you agree to accept and pay for the item(s) requested.

2.          Personal information submitted through the Site

In the course of using the Site, you may provide or we may collect information about you. We are committed to protecting the privacy of our customers’ information and explain our policy with respect to the use and disclosure of such information in our Privacy Policy , which can be reached by clicking on the “Privacy Policy” link located in the footer section of the Site (the “Privacy Policy”).

3.          Restrictions on the Use of the Materials in our Site

The Site and all of its content; including text, images, illustrations, designs, icons, photographs, video clips and other materials, and the copyrights, trademarks and/or other intellectual property in such materials are owned, controlled or licensed by Childhome. or third parties, and are protected from unauthorized use, copying and dissemination by copyright, trademark, publicity and other laws and international treaties.

You agree not to copy, reproduce, or modify any portion of the Site. This restriction includes copying, reproducing, or modifying any names, trademarks and logos which Childhome owns or has the right to use.

Material can be downloaded onto one computer for personal, non-commercial use only, provided copyright, trademark, or other proprietary notices are not changed or deleted. Any modification of the materials on our Site or use of them for any other purpose will violate our intellectual property rights and probably the intellectual property rights of some other parties.                                             

4.          Prohibited Conduct

Any conduct by you that in our sole discretion restricts or inhibits any other user from using or enjoying our Site will not be permitted. You agree to use our Site only for lawful purposes. You are prohibited from posting on or transmitting through the Site any unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, sexually explicit, discriminatory or otherwise objectionable material of any kind, including but not limited to any material that encourages conduct that would constitute a criminal offense, give rise to civil liability, or otherwise violate any applicable local, state, national, or international law. In addition, you shall not post any materials that (i) violate, plagiarize or infringe the rights of third parties including, without limitation, copyright, trademark, trade secret, confidentiality, contract, patent, rights of privacy or publicity or any other proprietary right, (ii) contain a virus, spyware, or other harmful component, (iii) contain embedded links, advertising, chain letters or pyramid schemes of any kind, or (iv) constitute or contain false or misleading indications of origin, endorsement or statements of fact. You further agree not to impersonate any other person or entity, whether actual or fictitious, including anyone from the Site or  Childhome. You alone are responsible for the content and consequences of any of your activities.

5.           Price

The prices stated for the products and services offered are in dollars excluding taxes, handling and shipping costs.

6.          Payment of products

Payment can be made in (one of) the manner (s) as indicated during the ordering process.

If you pay by credit card, you must give us your credit details when you place your order. The amount will be debited from your credit card at the time you confirm your order. We do not start with the delivery of your products until your credit card provider has authorized the use of your credit card for the payment of the ordered products. If we do not receive authorization, we will let you know.

If we have not received payment within 15 days of the date of your order, your order will be canceled.

You must pay for your order in the currency indicated on the invoice.

We will send you your invoice at the same time as the products to the address indicated on your order confirmation.

All items remain our sole property until they are paid in full.

7.          Treatment of Sales Tax

We are required by law to charge applicable sales tax on products shipped to those jurisdictions that levy such a tax (except in Hawaii and Puerto Rico). The sales tax quoted at time of checkout is only an estimate. The final total sales tax will be reflected on your invoice and will include state and local taxes, as well as any applicable rebates or fees.

8.           Retention of Title

Childhome retains full ownership of the products until all customer’ obligations have been met, in particular but not limited to the full payment of the price, costs and any interest. The customer is not allowed to alienate the product in the absence of full payment of the price.

9.          Risk Transfer

The risk transfer takes place with regard to the consumer at the time of delivery of the product.

10.     Delivery Term

Orders are delivered as quickly as possible. Any delivery periods on the website are only indicative, starting from the day following that on which the customer has placed his order.

11.     Place of delivery

Deliveries take place on the address given by the customer. If a package is returned to Childhome USA LLC due to an incorrect shipping address provided by a customer, the customer will be responsible for the return shipping cost as well as the redelivery cost. Shipping to PO boxes and military addresses is not possible. The shipping address cannot be changed once the order left the warehouse. If an order is refused at delivery, the customer will be responsible for the shipping back to Childhome USA LLC and any other charges that occur during the delivery process.

12.     Materials on Site

Unless otherwise specified, the materials in our Site are presented to provide information about Childhome, its products offered for sale and to provide related services and information to visitors.

Childhome in no way implies that the materials on our Site are appropriate or available for use outside of the United States. If you use our Site from locations outside of the United States, you are responsible for compliance with any applicable local laws. In addition, you may not use or export the materials in violation of U.S. export laws and regulations.

13.     Dispute resolution

Mindful of the high cost of litigation, not only in dollars but also in time and energy, both you and Childhome agree to the following dispute resolution procedure:

In the event of any controversy, claim, action or dispute arising out of or related to any transaction conducted on the Site, or the breach, enforcement, interpretation, or validity of these Terms and Conditions and the agreement they create or any part of it (“Dispute”), the party asserting the Dispute shall first try in good faith to settle such Dispute by providing written notice to the other party (by first class or registered mail) describing the facts and circumstances (including any relevant documentation) of the Dispute and allowing the receiving party 30 days in which to respond to or settle the Dispute.

Notice shall be sent
(1) to Childhome at: Childhome USA LLC, 1710 Old Highway 431, Wedowee – AL – 36278 – Attn: General Counsel, or
(2) to you at: your last-used billing address or the billing and/or shipping address in your online profile.

Both you and Childhome agree that this dispute resolution procedure is a condition precedent which must be satisfied prior to initiating any litigation or filing any claim against the other party.

14.     Disclaimer

The materials on the Sites are provided “as is” without warranties of any kind, either express or implied, including without limitation, warranties of title, implied warranties of merchantability, fitness for a particular purpose or non-infringement of intellectual property. Childhome expressly disclaims any duty to update or revise the materials on the Sites, although Childhome may modify the materials at any time without notice. Your use of the Site is at your sole risk, and you assume full responsibility for any costs associated with your use of the Site. Childhome shall not be liable for any damages of any kind related to your use of the Site.

15.     Errors, inaccuracies, and omissions

Occasionally there may be information on our Site that contains typographical errors, inaccuracies, or omissions that may relate to product descriptions, pricing, promotions, offers, and availability. We reserve the right to correct any errors, inaccuracies or omissions and to change or update information or cancel orders if any information on the Site is inaccurate at any time without prior notice (including after you have submitted your order).

16.     Colors

We have made every effort to display as accurately as possible the colors of our products that appear at the Sites. We cannot guarantee that your computer monitor’s display of any color will be accurate.

17.     Site Transactions

We reserve the right to refuse any order you place with us. We may, at our sole discretion, limit or cancel quantities purchased per person, per household or per order. These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address. In the event we make a change to or cancel an order, we will attempt to notify you by contacting the e-mail and/or billing address/phone number provided at the time the order was made. We reserve the right to limit or prohibit orders that, in our sole judgment appear to be placed by dealers, resellers or distributors.

18.     Return Policy

Our return policy, can be reached by clicking on the “Return Policy” link located in the footer section of the Site (the “Return Policy”).

 19.     Warranty

The full and official warranty can be found in the product User Manuel.

The warranty is for one year (12 months) from the date of purchase, covers repair or replacement, and is only valid in the country where the high chair is purchased. Proof of purchase must be provided in order to establish the original purchase date and price.

Warranty applies to original purchaser only and is not transferrable. Childhome USA products purchased from online auctions or unauthorized retailers, such as eBay, are not covered by warranty.

20.     Jurisdiction

These Terms and Conditions and the agreement they create, shall be governed by and interpreted according to the laws of the State of Alabama. Childhome reserves the right to bring any civil action in Alabama, arising from your violation of the Terms and Conditions of this Agreement.
